These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("Client," "you," or "your") and UAV Snap ("Company," "we," "us," or "our"). By accessing our website, booking our services, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT LIMITATIONS ON OUR LIABILITY, DISCLAIMERS OF WARRANTIES, AND A BINDING ARBITRATION CLAUSE. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE OUR SERVICES.
UAV Snap provides professional photography services, which may include aerial (drone) photography, interior photography, exterior photography, photo editing, virtual staging, day-to-dusk editing, overlay graphics, custom branding, and related visual media services (collectively, "Services"). The specific deliverables for each engagement are determined by the package selected at the time of booking.
Our Services are limited to the capture, editing, and delivery of photographic content. We do not provide real estate listing services, marketing services, sales services, staging services, or any other services beyond photography and photo editing unless explicitly stated in a separate written agreement.
We provide Services within our designated service area, which is subject to change at any time without notice. We reserve the right to decline or cancel any booking for a property outside our service area or for any other reason at our sole discretion.
A booking is not confirmed until payment has been received in full and you have received a written confirmation (via email or other electronic means). Submission of a booking request does not guarantee availability or acceptance.
You are responsible for ensuring that the property is accessible, properly prepared, and legally available for photography at the scheduled time. This includes ensuring all lights are functional, areas to be photographed are accessible, and any necessary permissions from property owners, tenants, HOAs, or other parties have been obtained. Failure to provide adequate access may result in cancellation of the shoot without refund.
By booking our Services, you represent and warrant that you have the legal authority to grant us access to the property and to authorize photography of the property. You agree to indemnify and hold us harmless from any claims arising from unauthorized access or photography.
We reserve the right to cancel, modify, or reschedule any booking at any time, for any reason, at our sole discretion. Reasons for cancellation may include, but are not limited to, weather conditions, equipment issues, safety concerns, airspace restrictions, staffing, scheduling conflicts, or any other reason we deem appropriate. In the event we cancel a booking, we will make reasonable efforts to reschedule. If rescheduling is not possible or acceptable to the Client, a refund may be issued at our sole discretion.
Cancellation requests must be submitted in writing (email to info@uavsnap.com) at least 48 hours prior to the scheduled shoot time. Cancellations made with less than 48 hours notice may forfeit the full payment. Cancellation policies are subject to change without notice.
Before initiating any formal dispute resolution process, you agree to first contact us at info@uavsnap.com and attempt to resolve the dispute informally for a period of at least 30 days.
Any dispute, claim, or controversy arising out of or relating to these Terms or our Services that cannot be resolved informally shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Bucks County, Pennsylvania. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against UAV Snap.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
You agree to use our website only for lawful purposes and in accordance with these Terms. You agree not to use the website in any manner that could disable, overburden, damage, or impair the website, or interfere with any other party's use of the website.
Our website integrates with third-party services including Stripe (payments), Calendly (scheduling), Google (analytics and advertising), and Tawk.to (live chat). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.
We reserve the right to modify, amend, or update these Terms at any time, with or without prior notice. Changes are effective immediately upon posting to our website. Your continued use of our Services after any modifications constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and UAV Snap with respect to your use of our Services and website, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
